Purpose of the petition

It is requested that the authorities of Luxembourg extend the ban on smoking to include all public outdoor spaces such as terraces, streets, parks, and public parking areas. The aim is to ensure the protection of public health, particularly of children and young people, and to promote a cleaner, healthier, and more sustainable environment throughout the country.

Reason for the petition

Luxembourg has made progress in tobacco control through the Law of 20 March 2018 on the Protection of Health (Loi du 20 mars 2018 relative à la protection de la santé), which strengthened restrictions on tobacco advertising and smoking in enclosed public places. Nevertheless, smoking in outdoor public spaces remains largely unregulated, resulting in continuous exposure of citizens - including families, workers, and children - to harmful secondhand smoke. Reasons for this request include: 1) Public health concerns: According to the European Commission Country Health Profile 2021, approximately 17% of adults in Luxembourg smoked daily. A more recent national survey (ILRES 2023) reported that 27% of residents aged 16 and above smoke, indicating a concerning increase, particularly among the 16-24 age group. 2) Exposure of children: The World Health Organization (WHO) affirms that there is no safe level of exposure to tobacco smoke. Even short-term exposure may harm children whose lungs are still developing. 3) Environmental impact: Cigarette butts are the most frequently discarded litter in Luxembourg, polluting parks, rivers, and streets with toxic chemicals that remain in the environment for years. 4) Right to equal protection: The presence of smoking in terraces and public areas prevents many non-smokers, parents, and vulnerable groups from fully enjoying public life. The right to breathe clean air in shared spaces is a basic right for all. Legal and Policy Context: • Luxembourg law already protects indoor public spaces, and the same legal logic could be extended to outdoor spaces where secondhand smoke exposure is unavoidable. • EU Directive 2014/40/EU (Tobacco Products Directive) highlights the importance of protecting young people from tobacco use and encourages Member States to implement stricter smoke-free measures. • Several European cities (for example, Barcelona, as well as areas in Belgium and the Netherlands) have already restricted smoking in outdoor terraces, parks, or beaches. Luxembourg could serve as a pioneer in the Greater Region by adopting similar measures. Requested Measures: • That the smoking ban be extended to all public outdoor areas, including terraces, pedestrian streets, parks, and public parking spaces. • That clear signage and controls be introduced in order to inform citizens and visitors about smoke-free zones. • That educational campaigns be strengthened to address young people specifically, raising awareness of the dangers of smoking and secondhand smoke. • That support programs for smokers be expanded, with designated smoking areas created away from spaces of public gathering. Closing Statement: This petition is not directed against smokers but is intended to ensure that the right to breathe clean air is respected and that the increasing prevalence of tobacco use among young people in Luxembourg is addressed. The creation of smoke-free public spaces would represent a decisive step toward a healthier, cleaner, and more inclusive society.
