No to raising the holding period from six to twelve months for tax-free capital gains on shares

Public petition n°4300

Object of the petition

We ask the Chamber of Deputies to reject the increase of the holding period from six to twelve months (article 99bis of the income tax law) announced with the 2027 budget, and to keep the current six-month rule.

Reason for the petition

Private individuals already pay a lot. The marginal tax rate on wages can reach 42%, before social contributions. What is left goes into rent or a mortgage that has become unaffordable, then into groceries and bills that go up every year. With whatever remains, some people invest. Not to gamble: for their retirement, for a deposit, for their children. The government itself encourages private pension saving, because nobody can guarantee the level of tomorrow's pensions. This money has already been taxed once. The six-month rule is one of the few that gives an employee a chance to build some wealth. Doubling it hits people who have to sell earlier than planned: a job loss, a separation, buying a home. Those who speculate are already taxed. Any sale within six months is taxed on the same scale as a salary, and holdings above 10% are taxed whatever the holding period. So the measure targets neither traders nor large fortunes. In the same budget, corporate income tax drops from 16% to 15%. Companies get relief while individuals who invest get squeezed. To our knowledge, no figure has been published on what this measure would raise.
