Update the requirements for parental leave to recognise the contributions of employees with long-term careers in Luxembourg

Purpose of the petition

This petition proposes to provide more opportunities to qualify for parental leave based on evidence of long-term employment in Luxembourg. This would be decided ultimately by legislators, but the petition suggests including the following tiers as eligible for leave cover: - Employed for more than 5 of the previous 6 years (60/72 months) - Employed for more than 2.5 of the previous 3 years (representing 30/36 months) - Employed more than ~1.9 of the previous 2 years (23/24 months) In addition to the current single tier of 12 months of uninterrupted work with no more than a 7 day break. All tiers maintain the minimum threshold of employment and completion of the trial period by the start of parental leave. These laws should also apply to adoptive parents in order to foster an inclusive environment for all families and situations.

Reason for the petition

Currently the requirements for parental leave state you must have been affiliated to the Luxembourg social security system on the basis of an employment contract for at least 12 consecutive months prior to the start in order to benefit from this policy. If you have a break of more than 7 days during the previous twelve months, you are limited to take parental leave only upon reaching the 12 month threshold, regardless of how long you have previously worked without interruption. For example, someone who has worked 15 years without interruption, could potentially not benefit from parental leave due to a gap of 8 days in their preceding twelve month work history. This law causes individuals and couples to delay family planning based on job changes, leading to a lower birth rate overall. For those who have children in this situation, infants lose out on valuable time with their parent(s) who cannot legally benefit from parental leave, or afford to take unpaid leave, causing the child to lose critical bonding time in their formative first months, and suffer a reduction in the long-term success of breastfeeding. For others who maintain employment diligently in order to meet the requirements, they are faced with reduced career opportunities, requiring them to stay in a potentially unfulfilling role or decline a promotion opportunity in a new organisation in order to maintain an uninterrupted employment contract. This represents a combined psychological and financial impact created by policies; not individuals' abilities or skills. While this is an issue that primarily affects the employment history of women, updating this law can help all potential parents to manage their unique situations in terms of career and family planning, as well as give children in Luxembourg a better head start in life, and encourage residents interested in both increasing the size of their families and advancing their careers to stay in Luxembourg long-term. This is an opportunity to benefit our country for years to come; sustaining population growth and investing back into our GDP by removing obstacles for advancing careers.
